Artificial Intelligence – AI
With the rapid development within AI, there are a lot of considerations to be made in relation to, among other things, IP. As an example, questions may arise about the rights to the generated product, including whether the use of AI to make the generated product may have infringed third party rights (in particular copyright and/or patent rights).
In addition, there are concerns about the use of AI in relation to confidential information and trade secrets. As a user of AI, you must be particularly careful not to accidentally make confidential information available to unauthorized persons, and you must be aware that AI will make it more difficult to keep trade secrets secret, since AI in certain cases can conduct so-called reverse engineering more easily than humans.
That said, besides the challenges and concerns that developments in AI have brought about, progress has also been made in relation to the possibilities of protecting, for example, IP. AI can be used to protect IP rights, as AI can make it easier to monitor unauthorized use of e.g. infringing trademarks etc. by others online and thus also to have the unauthorized use stopped earlier.
